MYTH: Being a Victim of an Accident Automatically Means A Lot of Money
There are many misconceptions about personal injury cases. The insurance industry is partly to blame for this misinformation. It is also due to the little amount of information that is provided to the general public on this subject. I am going attempt to clarify these myths once and for all. One of the most popular of the myths is that the accident victim is automatically going to get a windfall or in other words the court system is a lottery and they just won the big one.. Whenever a potential client comes into my office and the first thing they ask me is: "How much is my case worth?" or "How much money am I going to get?" I know that they have gotten a lot of misinformation either from the media, reading or even casual conversations. Many people think that because they were injured in an auto accident that their ship has come in and that they are going to be taken care of the rest of their life. This is sometimes the case but not usually. Accidents cause serious injuries to innocent victims and should never be considered as gifts.
Cases involving personal injuries can be difficult to prove. One of the first things a victim has to prove is that the accident was the fault of someone else. Usually that someone else is looking to put the blame elsewhere. Also you have to prove that your injuries were caused by the accident and not old injuries from something in your past. These are just two of the hurdles. If you get over these hurdles you must then convince the jury that your injuries are worthy of compensation.
When a case is presented to a jury it is the burden of the accident victim to prove liability and damages to the jury by a preponderance of the evidence. Accident victims in Kentucky need to know that juries in Kentucky have historically been very conservative. In other words, it is a difficult task to convince them to give a large and fair award for damages unless the injuries are significant. Unfortunately the insurance companies are aware of this. This information is something they always consider when they use their computer programs which determine what the insurance company considers the value of your car accident case to be. In other words, what they will settle your accident case for. You must have provable damages to make a recovery. No matter how large the settlement amount is it is never worth it if you are truly injured and must endure pain for the rest of your life. There are no windfalls when you are facing a lifetime of agony and loss.
